1. About us

These Terms and Conditions govern the sale of hardware goods and related services by Wambu Hardware Limited (KRA PIN P051704967S), a limited company incorporated in Kenya under the Companies Act, 2015, with its principal place of business at P.O. Box 74-20600, Maralal, Samburu County, Kenya.

By placing an order, submitting a quote request, or purchasing goods from us in store or online, you agree to be bound by these Terms. They apply alongside, and do not displace, your rights under the Sale of Goods Act (Cap 31) and the Consumer Protection Act, 2012.

2. Products and descriptions

We make every effort to describe our products accurately. Images, descriptions and specifications are provided for guidance and may vary slightly from the physical product, particularly in colour, finish and natural variation in timber and aggregates.

All products are subject to availability. We may withdraw any product from sale at any time without notice.

3. Pricing

All prices are in Kenya Shillings (KES) and are inclusive of VAT at the prevailing rate where applicable, charged in accordance with the Value Added Tax Act, 2013. The VAT component is shown on the quotation and invoice.

Quote requests submitted through our website are not binding offers. A binding price is established only when we issue a formal written quotation or sales order and you confirm acceptance. Unless the document states otherwise, a quotation is valid for seven days from the date of issue.

We may correct pricing errors. If an error comes to light after you have placed an order, we will tell you and you may proceed at the corrected price or cancel the order and receive a full refund of anything already paid.

4. Orders and acceptance

An order is accepted when we confirm in writing — by invoice, receipt, or WhatsApp message from a number published on this site — that the goods are available and the transaction is confirmed.

We may decline any order at our discretion, including where stock is unavailable, where the order cannot be fulfilled at the stated price, or where we have reasonable grounds to suspect fraud or misuse.

5. Payment

Payment is due at the time of purchase unless a credit account has been agreed in writing. We accept cash, M-Pesa (Paybill 522533, account 5873286), and bank transfer to our Equity Bank or KCB Bank accounts.

Bank account details are issued on our quotations and invoices. Before transferring funds, verify the account against a document issued by us or by telephoning a number published on this website. We will never send you new bank details by message alone, and we are not liable for payments made to an account we did not issue.

For credit account customers, payment terms are those set out in your credit agreement. Overdue accounts may attract interest at 3% per month on the outstanding balance. We may suspend or withdraw credit facilities where payment obligations are not met.

6. Delivery

Where delivery is offered, timelines are estimates rather than guarantees. We are not liable for delays caused by matters outside our reasonable control, including road conditions, weather, security restrictions, or supplier delays.

Delivery charges, where they apply, are set out on the quotation before dispatch so that the total spend is visible before you commit.

7. Title and risk

Risk in the goods passes to you on delivery or, where you collect from our premises, on collection.

Title to the goods remains with Wambu Hardware Limited until we have received payment in full. Until then you hold the goods as bailee and must keep them identifiable and insured.

8. Returns and refunds

We accept returns of goods that are defective or not as described within 7 days of purchase, provided the goods are in original condition and accompanied by proof of purchase.

Goods cut to size, mixed to specification such as tinted paint, or specially ordered cannot be returned unless defective.

Refunds are processed to the original payment method where possible. A credit note may be issued in place of a refund at our discretion. Nothing in this clause affects your statutory right to reject goods that are not of merchantable quality or not fit for their purpose.

9. Warranties

Products carry the benefit of any applicable manufacturer warranty. We do not offer additional warranties beyond those the manufacturer provides.

Nothing in these Terms limits or excludes your rights under Kenyan consumer protection law, including the Consumer Protection Act, 2012 and the Sale of Goods Act (Cap 31), or the implied conditions as to quality and fitness for purpose that those statutes provide.

10. Limitation of liability

To the maximum extent permitted by Kenyan law, Wambu Hardware Limited is not liable for indirect, incidental or consequential loss arising from the use of, or inability to use, our products or services.

Our total liability for any claim under these Terms shall not exceed the value of the goods or services giving rise to the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud, where such exclusion is not permitted by law.

11. Intellectual property

All content on our website, including text, images, logos and trade marks, is the property of Wambu Hardware Limited or is used with permission, and is protected by the Copyright Act, No. 12 of 2001 and the Trade Marks Act (Cap 506). You may not reproduce, distribute or use our content for commercial purposes without our written consent. See our Copyright Notice for permitted uses.

12. Dispute resolution

We aim to resolve any dispute amicably. If you have a complaint, contact us first at wambuhardwarelimited@gmail.com, by telephone on 0140 782 822, or on WhatsApp at +254 713 279 229.

Where a dispute cannot be resolved amicably, the parties shall attempt mediation administered under the rules of the Nairobi Centre for International Arbitration before commencing proceedings. Nothing in this clause prevents either party from seeking urgent interim relief from a court, or a consumer from pursuing a complaint through the Competition Authority of Kenya.

13. Governing law

These Terms are governed by and construed in accordance with the laws of Kenya, and are subject to the exclusive jurisdiction of the courts of Kenya.

14. Changes to these Terms

We may update these Terms from time to time. The effective date shown above reflects the current version. The Terms that apply to your purchase are those in force on the date your order is accepted, and a later change does not alter a contract already formed.
