1. Acceptance of terms

These Terms of Use govern your access to and use of the websites operated by Wambu Hardware Limited (KRA PIN P051704967S), including wambu.org and marketing.wambu.org (together, the “Site”).

By accessing or using the Site you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Site.

The Site is intended for individuals and businesses seeking hardware products and services from Wambu Hardware Limited. You must be at least 18 years of age, or accessing the Site with the consent of a parent or guardian, to submit any form or enquiry.

Use of the Site for business purposes is permitted provided you comply with these Terms.

3. Permitted use

You may use the Site to browse product information, request quotations, contact us and read about our services. You agree to use the Site only for lawful purposes and in a manner consistent with these Terms.

You must not:

• Use the Site in any way that breaches applicable Kenyan law or regulation.

• Attempt to gain unauthorised access to any part of the Site or its underlying systems, which is an offence under the Computer Misuse and Cybercrimes Act, 2018.

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity, including by holding yourself out as acting for Wambu Hardware.

All content on the Site — text, images, logos, product descriptions and design elements — is owned by or licensed to Wambu Hardware Limited and protected under the Copyright Act, No. 12 of 2001. All rights are reserved.

You may view, print or download content for your own personal, non-commercial use. Any other use requires our prior written consent. Our Copyright Notice sets out what is permitted without asking.

5. Quote requests and enquiries

Quote requests and contact form submissions open a pre-written message in WhatsApp on your own device, addressed to our business account. These are enquiries only and do not form a binding order or contract. A binding contract arises only when we issue written confirmation, as set out in our Terms and Conditions.

By submitting an enquiry you consent to us contacting you by WhatsApp, telephone or email to deal with it. Our Privacy Policy explains how we handle your personal data.

6. Third-party links and services

The Site links to third-party services, including WhatsApp and telephone networks. We are not responsible for the content, privacy practices or availability of third-party services, and accessing them is at your own risk.

7. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including as to accuracy, completeness or fitness for a particular purpose. Product availability and prices shown on the Site are indicative; the binding figure is the one on a quotation issued by us.

8. Limitation of liability

To the fullest extent permitted by Kenyan law, Wambu Hardware Limited is not liable for loss or damage arising from your use of, or inability to access, the Site, including indirect, incidental or consequential loss.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded or limited under Kenyan law.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use personal data in accordance with the Kenya Data Protection Act, 2019.

These Terms of Use are governed by the laws of Kenya. Any dispute arising under or in connection with them is subject to the exclusive jurisdiction of the courts of Kenya.
